Clean Chit for PC in 2G Case, “Plea without any merit and is dismissed” Judge.

A plea to make home minister P Chidambaram a co-accused in the 2G scam case was dismissed after half a day of frenzied action outside the Patiala House courts in Delhi and weeks of anticipation in political circles.
“I do not find sufficient ground for proceeding against Chidambaram. The plea is without any merit and is dismissed”, special CBI judge OP Saini said in the courtroom, in the presence of Subramanian Swamy, his wife and his lawyers.

 

The media, which had been crowding the court premises since morning, was made to stay outside, to maintain order, till the judge pronounced his verdict at 1.10pm – deferred twice, once from 10am and then from 12.15pm.

The order comes after successive setbacks for the government as the Supreme Court rapped it for inordinate delay in grant of sanction to prosecute Raja, cancelled 122 2G licences and slammed the process followed to fix the army chief’s age.

Swamy said that he’d take his challenge to Supreme Court.

Chidamabaram was finance minister when jailed former telecom minister A Raja gave away telecom licences illegally. Swamy had alleged that Chidambaram was equally culpable and had conspired to make money out of the deal.

The court noted that there was no evidence that Chidambaram had colluded with Raja “to subvert telecom policy and obtain pecuniary advantage for himself”.

It said that “anybody and everybody associated with a decision in any degree cannot be roped in as an accused”.

In his 64-page judgment, Saini said, “Chidambaram was party to only two decisions, that is, keeping the spectrum prices at 2001 level and dilution of equity by the two companies. These two acts are not per se criminal. In the absence of any other incriminating act on his part, it cannot be said that he was prima facie party to the criminal conspiracy.”

It said, “There is no material in record to suggest that Chidambaram was acting with corrupt or illegal motives and was in abuse of his official position while consenting to the two decisions taken with Raja… one may be acting innocently and other may be actuated by criminal intention. Innocuous, inadvertent or innocent acts do not make one party to the conspiracy.”

Congress in back lash mood blaming the opposition BJP for targeting Chidambaram and the Govt. for political gains Govt and Leaders of ruling alliance have stood behind Chidambaram defending him and claiming it was the policy of NDA govt for  first come first served which is main culprit and Raja has to be blamed fully 2G fiasco.

Where does all this take the BJP and the opposition, and Subramaniyam Swamy who happens to be also from Tamil Naidu so are Raja and Chidambaram.
One has to understand and find what made Subramaniam Swamy so averse to PC, that even after the Saini Judgement clearly giving PC clean chit Subramaniyam openly refuses to respect the judgement as it should be instead it says the Judges interpretation and the judgement is wrong,  and he has just lost a battle in 2G against PC but not the war.
Subramaniyam has three months to file appeal in High Court, he is going to fight the battle to demand making Chidambaram co accused in 2g with Raja, and prove in court of law that their is a criminal intent and collusion between Raja and PC.  ”have shown that the two of them got together, prima facie that suggests that the two of them conspired because they dealt together in four meetings” Subramaniyam said.
But the court finds no evidence or material in the material Subramaniyam filed as even enough to send a summon to PC, in such a case the battle that is lost in CBI by Swamy will have a very tall challenge to disprove the CBI Court in HC, and take it to SC.  Subramaniyam who has taken the cause of bringing about the scam in 2g, has gained lot of successs with Raja in jail with many others, out of them,  most are out.
Subramaniyam shows his adamant attitude by not respecting with dignity and honor the CBI courts judgement, his openly pointing figure that Judge Saini may be wrong, or his judgement is wrong amounts to putting judiciary under scanner, when he has the legal option to knock the higher courts. This is how courts and legal system functions and battles are fought on merits not on perceptions.
BJP lost a carrot, Congress got one, Subramaniyam has tons of preparation to work on before to file an appeal, it is Chidambaram and the team of Congress top leaders like Pranab, Kapil Sibal and Abhishek Manu Singvi and with the top leader ship of congress to rejoice on a moral victory and a slap on BJP  and its campaign to corner PC ends in anticlimax a least for a long time it is loss of pressure point for BJP.
Will this episode be good for our system which is struggling to find level ground to fight corruption in high places or will this be seen as victory of judiciary and upholding of our legal system that has  wisdom and power to judge on merits and not take decision on sentiments and media frinze and influencing campaigns by political parties.  Common man will he get confused or will he take it on its merits like the judge did, hope it will.

CBI frames charges on Raja, Kanimozi & 15 others in 2G.

NEW DELHI: The 2G spectrum case on Saturday reached an important milestone with a Delhi court framing charges against all the 17 accused including former telecom minister A Raja and DMK MP Kanimozhi and corporate honchos.

 

Special CBI judge O P Saini also ordered that trial in the case will commence from November 11 with all the accused refusing to plead guilty to various offences.

 

“….Thereby, you all committed an offence punishable under Sections 120-B (criminal conspiracy) read with 409 (criminal breach of trust), 420 (cheating) 468 and 471 (forgery) of the Indian Penal Code and Section 7 or in alternative Section 11 read with Section 12 and 13(2) read with 13 (1b) of the Prevention of Corruption Act and within my cognisance,” the judge said in his 700-page order.

 

While framing charges, the judge observed that there is evidence against Raja, his former private secretary R K Chandolia and former telecom secretary Siddhartha Behura.

 

With today”s development, accused can now move for bail as observed by the Supreme Court during the hearing of the bail petition by Kanimozhi earlier.

 

The judge said evidence is there for framing of charges against telecom firms Reliance Telecom Ltd, Swan Telecom and Unitech (Tamil Nadu) Wireless Ltd.

 

He also said CBI has also brought evidence to frame charges against corporate executives of Reliance Anil Dhirubhai Ambani group”s Managing Director Gautam Doshi, Surendra Pipara, Group”s President and Hari Nair, senior Vice President.

 

Others against whom charges have been framed are Swan Telecom promoter Shahid Usman Balwa, his cousin Asif Balwa, their colleague Rajeev Agarwal, Unitech Ltd”s MD Sanjay Chandra and DB Realty MD Vinod Goenka.

 

The judge said there was prima facie evidence for framing charges also against Kalaignar TV”s MD Sharad Kumar and Bollywood filmmaker Karim Morani.

 

“You accused A Raja and Siddarth Behura dishonestly in pursuance of the conspiracy disposed of/allocated valuable spectrum, over which you were having dominion which was entrusted to you in the capacity of public servant to M/s Swan Telecom Pvt Ltd and M/s Unitech Wireless (Tamil Nadu) Ltd in violation of law with a view to cause wrongful gain to these companies thereby you committed an offence punishable under Section 2409 read with 120-B and within my cognisance,” the judge said.

 

The court found prima facie evidence to frame various penal charges including cheating, forgery, abetment and criminal conspiracy against the accused.

 

It also found prima facie evidence of abuse of official position by Raja, Chandolia and Behura.

 

The court had reserved its order on October 14 after hearing day-to-day arguments on behalf of accused and the CBI for nearly two months.

 

The CBI, in its first chargesheet filed on April 2, had charged Raja and others with causing a huge loss of Rs 30,984 crore to the exchequer by allocating spectrum to ineligible operators as per a criminal conspiracy among themselves.

 

Special CBI Prosecutor U U Lalit had argued that there was “sufficient prima facie” evidence against all the accused to proceed with the trial as everyone of them was part of the conspiracy and the intent to commit offence “may be inferred from their knowledge”.

 

On the other hand, all the accused including Raja had vehemently opposed the framing of charges and the plea of CBI that they caused a loss to the state in the grant of spectrum licenses.

New Delhi: A special CBI court in Delhi is likely to frame charges on Saturday against 17 people accused in the 2G Scam including former Telecom Minister A Raja and DMK MP Kanimozhi.

Kanimozhi’s father DMK chief Karunanidhi arrived in Delhi on Friday and is likely to meet UPA chairperson Sonia Gandhi on Saturday.

Special Judge OP Saini will decide whether the accused will be charged under criminal breach of trust or not.

Under criminal breach of trust charge, an accused if convicted, can be given a life sentence.

The CBI filed its first chargesheet seven months ago, in which it called Raja the mastermind. He has been in jail since his arrest on February 2. The CBI also named some of the biggest corporate executives and companies in the country.

The others accused in the scam include former Telecom Ministry officials, Anil Ambani owned ADAG group officials, Kalaignar TV’S Sharad Kumar, Shahid Balwa of Swan Telecom, Unitech’s Sanjay Chandra and DB Realty MD Vinod Goenka.

Kanimozhi has been lodged in jail for almost six months and has been denied bail. The court will resume hearing on the bail applications of various accused, including that of Kanimozhi, from October 24.

PM, Govt. considering “law for private sector bribery as criminal offence”

Private Sector Bribery will may become criminal offense, if this happens it will be good step ahead as bribes originate from big corporate set ups, who practice un ethical deals in govt and ministries it is exposed in 2G investigations.
He urged the CBI that people induldging in corruption must realise that that they can not possibly get away from the law and would sooner rather than later suffer the consequences of their wrongdoing.”There is a need for speedy and thorough investigation into allegations of such wrong doings, followed by expeditious prosecution to bring the guilty to book. This would act as a powerful deterrent against corruption,” he said.

The Prime Minister said expectation from the CBI are well known but need repetition because this because sometimes in the routine of daily work the larger scheme of things are forgotten.

“We expect from the CBI the highest standards of honesty and professionalism and a total disregard of any extraneous considerations, particularly political pressure, in its work…And professionalism demands facelessness, in the best traditions of our civil services,” he said.

He cautioned “premature publicity” given to cases can harm the cause of justice.

“We must also not forget the distinction between a deliberate attempt at wrongdoing and honest mistakes, sometimes inevitable in decision-making processes under conditions of uncertainty,” the Prime Minister said.

On CBI director’s concerns of pending sanctions of prosecution and delay in trials, Prime Minister Manmohan Singh said government has decided that if an authority refuses to grant permission for investigation or sanction for prosecution, the reasons for such denial would have to be informed to the next higher authority.

If the Govt of UPA is able to work on these lines with a strong Lokpal Plus, Bill against Private  Sector Bribery, it will be a big move forward in bringing in transiency in to the system and deter the corrupt in govt and in private sectors.
Sooner the better. Absence of such stringent measures against the private sector has encouraged them to work on and promote voices against just the political parties and silent on the private sector.
Event the movement of Civil Societies and groups working aggressively  are silent on this aspect,even  Hazare is silent on this aspect. It gives reason to doubt why is it Hazare is silent on such a important nexus that had partnered scams in collision with the politicians and bureaucrats in Govt.”Delay in the trial of cases remains an area of serious public concern. To reduce pendency of CBI cases under trial, we have taken a decision to set up a committee under a retired SC judge to review cases pending trial, which are more than ten years old, and suggest ways and means for their speedy disposal,” he said.

2G: Order on Kanimozhi bail plea reserved till 14th May.

2G scam CBI Judge differed order on Bail of Konimozi DMK till 14th of May and also instructed Kanimozi and others to visit court daily till May 14th.

The CBI Opposed Dravida Munnettra Kazhagam (DMK) MP Kanimozhi’s bail plea, claiming that she is the controlling mind behind Kalaignar TV. The CBI also pleaded in the court to send Kanimozhi and Kalaignar TV CEO Sharad Kumar to judicial custody.

After a long argument by Special Public Prosecutor UU Lalit, who appeared for the CBI, Judge OP Saini reserved the hearing on bail plea of Kanimozhi and others till May 14. The court also asked Kanimozhi and Sharad Kumar to appear before the court daily till May 14.

Earlier, Lalit argued in the Patiala House Court during the hearing in the 2G spectrum scam case that the 2G money trail leads to Kalaignar TV where Kanimozhi, the 43-year-old daughter of Tamil Nadu Chief Minister M Karunanidhi, has a 20 per cent stake. Continue reading
